These Terms of Service ("Terms") constitute a legally binding agreement between HYVOR (Address: 10 RUE DE PENTHIÈVRE 75008 PARIS), the provider of FortGuard ("we," "us," or "our"), and users of the FortGuard API Service ("you" or "user"). The FortGuard API Service is accessible at fortguard.io.
By accessing or using the FortGuard API Service, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you are not authorized to use our services.
The FortGuard API Service encompasses two distinct APIs: the spam detection API and the IP API. The spam detection API employs third-party language models for the identification of spam content within various applications, acknowledging the potential presence of issues inherent in language models. The IP API furnishes data points related to IP addresses, with an acknowledgment of the potential for data inaccuracies.
Access to the FortGuard API Service necessitates the creation of a HYVOR account on hyvor.com. Users are solely responsible for maintaining the confidentiality and security of their account credentials.
Users may create projects in the FortGuard Console to obtain API keys. Comprehensive details regarding access, rate limits, and API credit usage are described in the official documentation accessible at https://fortguard.io/docs.
All intellectual property rights, including but not limited to the API, trademarks, and copyrights, are and shall remain the exclusive property of HYVOR. Users are granted a limited, non-exclusive right to use trademarks and branding in accordance with guidelines provided.
The collection and processing of data through the FortGuard API Service adhere to the General Data Protection Regulation (GDPR). Additional particulars are delineated in our privacy policy, which users are encouraged to review. While we do not log data (content and IP addresses) transmitted to our APIs, users are advised that third-party service providers may log or retain data; detailed information is available in the privacy policy.
User data and proprietary information are treated with the utmost confidentiality, and we are committed to maintaining the confidentiality of such information.
Payments are facilitated by our designated merchant of record, Paddle. Each project subscription requires active payment, with a 14-day trial period provided. Subscription costs, inclusive of taxes (USD, unless expressly stated otherwise), are clearly elucidated on our official pricing page. The API credits system governs the determination of pricing, with no provision for the rollover of additional credits. Additional costs may be incurred based on API usage.
Refunds are generally not provided, except under exceptional circumstances, and the company reserves the sole discretion to make decisions regarding refunds. Customers seeking a refund must contact our customer support team, providing detailed information regarding their exceptional circumstances. The company will review such requests on a case-by-case basis and may, at its discretion, determine whether a refund is warranted.
Users reserve the right to terminate their subscription at any juncture, subject to compliance with any outstanding financial obligations. Additionally, the company reserves the right to temporarily or permanently revoke access to the API if the user's API usage causes issues for our service, including but not limited to Distributed Denial of Service (DDoS) attacks. Such actions will be taken at the discretion of the company, and affected users will be notified promptly. Termination of API access under these circumstances does not release the user from any outstanding financial obligations.
In no event shall HYVOR be liable for any indirect, incidental, special, consequential, or punitive damages, including, but not limited to, loss of profits, loss of data, or business interruption, arising out of or in connection with the use or inability to use the FortGuard API Service, even if HYVOR has been advised of the possibility of such damages.
HYVOR reserves the right to modify, amend, or update these Terms at any time. Users will be notified of material changes via email or through the FortGuard Console. Continued use of the service after such modifications constitutes acceptance of the revised Terms.
If you do not agree with any amendments to these Terms, you may terminate your account and discontinue using the FortGuard API Service. Your continued use following notice of changes will be deemed as acceptance of the amended Terms.
These Terms are governed by and construed in accordance with the laws of France, without regard to its conflict of law principles.
The failure to enforce any provision of these Terms shall not constitute a waiver of that right. These Terms constitute the entire agreement between users and HYVOR, superseding any prior agreements or understandings. HYVOR reserves the right to assign its rights and obligations under these Terms without notice to users.
